An incident involving a Lebanon Police officer April 19 at Higdon's Foodtown IGA is under investigation. Jimmy Higdon made the complaint, according to Lebanon Police Chief Joe Bell's report to the Lebanon City Council.

Bell said Monday evening that the Kentucky State Police are investigating the incident.

Waters, 45, of 182 Hamilton Heights is accused of two counts of theft by deception, according to a summons issued May 5. The summons accused Waters of obtaining merchandise from Higdon's IGA by creating a false impression the packaging of other items purchased also included the merchandise unlawfully taken.

The uniform citation filed with the case reads that on April 19 Waters allegedly put four no-bake cookies into a bag and only paid for two cookies.

A hearing is scheduled for May 17 in Marion District Court.
