Judicial center case dismissed

A lawsuit related to the construction of the Marion County Judicial Center has been dismissed.

On Nov. 9, 2011, Maynard and Mitchell Interiors, Inc., filed a complaint against the Marion County Fiscal Court, Codell Construction, and Travelers Casualty and Surety Company of America.

On April 19, the case was dismissed. The agreed order noted that the parties in the case agreed to bear their own costs and attorney fees.

According to the complaint, Maynard and Mitchell was subcontracted by Codell Construction for labor, material and supplies in March of 2009, and during the period ending Aug. 25, 2011, Maynard and Mitchell furnished labor, material and supplies.

Maynard and Mitchell argued that it was still due to receive $40,586.76. On Sept. 28, Maynard and Mitchell filed a lien in the Marion County Clerk's Office regarding this amount, and on Oct. 13, Maynard and Mitchell received a letter notifying them that Codell Construction was protesting the lien.

Codell has a surety bond with Travellers and Marion County Fiscal Court owns the building.
