Marion Circuit Judge Allan Bertram has issued an order setting aside an earlier decision dismissing a case against the City of Lebanon. In the same order, Bertram declared null and void the city's annexation of approximately 415 acres.
"The Court has concluded, as a matter of law, that the annexation conducted by [the city] was, in fact, arbitrary and unreasonable and violative of Plaintiff's constitutional rights under Section 2 of the Bill of Rights of the Kentucky constitution," Bertram wrote.
