Phillips found guilty of assault

Korey Phillips, 25, of 330 Shuck Avenue was sentenced to 90 days in Marion Circuit Court recently for fourth-degree assault. He was also fined $500 and ordered to pay $175 court costs. Phillips was found not guilty of second-degree burglary and terroristic threatening.
In a separate case, Phillips received two years of diversion for flagrant non-support. He was ordered to pay $150 court costs and to continue to make child support payments and pay on arrears.

In other circuit court news:
- Larry Peters, 44, at 400 Oak Street Apt. 58 in Hodgenville received three years of diversion for first-degree promoting contraband. He was ordered to serve 90 days within six months and to pay a $1,000 fine and $150 court costs.
- Alan B. Lancaster, 51, of 127 Beechwood Street in Lebanon received three years of probation for first-degree possession of a controlled substance. He was ordered to pay $175.
- Stephen Lanham, 41, of 3035 Tatum Lane in Gravel Switch received 24 months of probation for first-degree criminal trespassing. He was ordered to pay court costs.
Charges of third-degree criminal mischief, menacing, third-degree terroristic threatening, disorderly conduct, first-degree persistent felony offender and resisting arrest were dismissed.
- James R. Spalding, 20, of 628 Chandler Street in Lebanon was referred to drug court on three counts of first-degree trafficking in a controlled substance/cocaine first offense and three counts of possession of drug paraphernalia first offense.

Sentencing pending
- Derrick J. Johnson, 40, of 650 Miller Pike of Lebanon pled guilty to DUI fourth offense. His sentencing is scheduled for April 14.
Charges of driving on a DUI suspended license (third or subsequent offense, aggravating circumstance), careless driving, failure of non-owner operator to maintain required insurance and first-degree persistent felony offender were dismissed.
- Emmitt Lee Cowherd, 47, of 555 Maple Street Apartments #44 in Lebanon pled guilty to first-degree fleeing or evading police. His sentencing is scheduled for April 14.
Charges of first-degree possession of a controlled substance second offense, second-degree fleeing or evading, possession of drug paraphernalia, second-degree wanton endangerment, DUI second or subsequent offense, unauthorized use of a motor vehicle, resisting arrest, failure to produce insurance card, reckless driving and first-degree persistent felony offender were dismissed.

Dismissals
- A charge of second-degree burglary was dismissed against Julie Smothers, 42, of 3045 Tatum Lane in Gravel Switch based on the plea of the co-defendant. Smothers stipulated to probable cause.
